This one-hour webinar will discuss Defective Pricing including the underlying regulations, the expanding and contracting role of DCAA audit oversight, the implications for contractor business systems and published decisions interpreting Defective Pricing (or noncompliance with Truth-in-Negotiations Act or TINA)

At the completion of this one hour seminar, participants will be able to:

  • Identify the FAR clause(s) which define Defective Pricing and requirements for certified cost or pricing data
  • Identify the DFARS Business Systems which are interrelated with Defective Pricing
  • Identify DCMA and DCAA instructions or policies related to defective pricing
  • Identify ASBCA decisions concerning defective pricing
  • Identify DOD-IG fraud indicators which involve certified cost or pricing data and/or defective pricing

During the seminar, your faculty will share their knowledge of defective pricing and evolving trends which reinforce the requirements to be ever vigilant in establishing internal controls to mitigate the risks of noncompliance with TINA (Truth in Negotiations Act). These risks expand beyond TINA and are not limited to prime contractors; in particular, alleged TINA noncompliances can be construed as estimating system deficiencies, procurement deficiencies, fraud referrals and “blemishes” on government data bases concerning contractor past-performance. This webinar will emphasize the need for proactive measures to avoid defective while also discussing what to expect if/when DCAA performs a post-award audit and the very stringent criteria for the government to prevail on allegations of defective pricing. .
