This one-hour webinar will discuss recent and evolving trends applicable to prime contractor management of subcontracts. The discussion will address pre-award responsibilities as well as post-award responsibilities in the wake of an ASBCA decision which essentially invalidated DCAA expectations regarding prime contractor “management” of subcontractors.

At the completion of this one hour seminar, participants will be able to:

  • Identify the FAR clause(s) which implicate prime contractor responsibilities for subcontractor cost or pricing data (pre-award)
  • Identify the FAR clause(s) which implicate prime contractor responsibilities for subcontracts during contract execution and close-out
  • Identify the ASBCA case(s) which are directly related to prime contractor administration of subcontracts
  • Identify internal agency policies and instructions which specifically address prime contractor roles and responsibilities relative to subcontracts

During the seminar, your faculty will share their knowledge of recent and evolving trends which define government expectations of prime contractors. Those expectations have been expanding ever since the Commission on Wartime Contracting reported in 2008 that prime contractor (weak) management of subcontractors was a factor leading to unreasonable costs in government contracts. However, a 2016 ASBCA decision all but invalidated DCAA and DCMA expectations for prime contractor “management” of subcontracts, particularly with respect to after-the-fact actions to settle subcontractor direct and indirect costs.
